One judge even had the audacity to point out that refusing illegal orders is, like, literally taught at West Point. Someone get this woman a MAGA hat, stat!
The DOJ lawyer, bless his heart, tried to argue that retired military officers are basically still under the thumb of the brass and can't go around spouting off about disobedience. Because heaven forbid someone questions the glorious wisdom of our military overlords.
Kelly, meanwhile, is playing the First Amendment card, claiming his right to speak truth to power is being violated. And honestly, he's not wrong. The whole thing smacks of a desperate attempt to silence anyone who dares to question the narrative.

Apparently, telling people they can refuse illegal orders is a bridge too far for the Woke Military-Industrial Complex.
Now, the appeals court is going to have to decide whether Kelly's speech is protected or whether the Pentagon gets to continue its reign of terror. Either way, this is a victory for those who believe in free speech, even if that speech involves reminding people that they don't have to follow orders that violate the Constitution or basic human decency.
